How does same-sex marriage work in Brazil?
Same-sex marriage is legalized by Resolution 175, published by the CNJ on May 14, 2013. Since then, any registry office in the national territory is required by law to perform civil marriages for same-sex couples.

- Two witnesses who must be literate and carry identification documents.
If one of the bride and groom is divorced, they must also bring an updated marriage certificate stating the divorce. However, if one of the bride and groom is already a widower, it is necessary to bring the marriage certificate and the death certificate of the spouse.
With all the documentation in hand, all you need to do is pay the fees for the service. Just like civil marriage between heterosexuals, the couple must prepare in advance for some things, such as:
- What property regime will be used for the marriage?
- Which civil wedding style to choose.
Which property regime to choose?
This is a decision that should be discussed beforehand by the couple in order to choose the best option for both of them.
There are 3 different types of property regime that can be chosen for a civil marriage:
- Partial community of property: in which the property acquired after the marriage is owned by both parties. This is the most common property regime and in these cases, all property acquired before the marriage remains the sole and exclusive property of its owner by law.
- Total community of assets: with this system, everything acquired before and after the marriage belongs to both parties. For this type of marriage, it is necessary to go to a Notary's Office in advance to draw up a deed.
- Total separation of assets: in this system, each person continues to own their property, even after the marriage. For this system, it is also necessary to draw up a deed at the Notary's Office.
Which civil wedding style should I choose?

- Civil marriage at the registry office: this is the simplest option, carried out at the registry office itself by a judge and a clerk.
